Energy code reform: Code manager licence conditions and code modification appeals to the CMA

We have decided to proceed with the majority of the proposals on the code manager licence as set out in the consultation.

We have made minor changes across several licence areas to better reflect our policy intent and to incorporate stakeholder feedback. Such areas include but are not limited to:

On our proposed updates to the code modification appeals process to the Competition and Markets Authority (CMA), we have also decided to proceed with the majority of the proposals as set out in the consultation. We intend to:

  • retain the existing scope for appeals and bring the Retail Energy Code (REC) in to scope
  • retain the existing eligibility to appeal criteria
  • proceed with replacing the code panel’s (or equivalent body) code modification recommendation with that of the code manager’s. This recommendation will form the new basis of the appeals trigger
  • change our position on alternative code modifications to now require a code manager to provide a single recommendation to Ofgem for approval
  • This response is a key milestone towards implementing the new code governance framework. Following this publication we intend to:

  • move forward with the Secretary of State determining the code manager standard licence conditions (the process by which these conditions would be brought into legal effect)
  • lay secondary legislation to reflect the updated code modification appeals process to the CMA
  • We received 31 responses to this consultation from a wide range of interested parties, including:

  • energy transmission and distribution companies
  • other interested parties, such as industry associations and consumer groups
  • DESNZ and Ofgem are seeking views on proposals for energy code manager licence conditions and code modification appeals to the Competition and Markets Authority (CMA).
