Remediable Service Statement Delivery Update

Update on Advocate General for Scotland v Milroy

The Ministry of Defence (MOD) can confirm that it has been granted permission to appeal in the case of Advocate General for Scotland v Milroy.

The appeal will now proceed through the next stage of the legal process. As the matter remains before the courts, it would not be appropriate to comment in detail.

Further updates will be provided in due course.

Mr Milroy originally made a claim against MOD in June 2020 on the grounds that the way in which MOD calculates the attendance-based pay divisor for Volunteer Reservists and the failure to provide access to an occupational pension for reserve service before 1 April 2015 amounted to less favourable treatment of part-time workers.

In April 2023 the Employment Tribunal heard the case. The judgment of the Employment Tribunal was in favour of the claimant.

MOD subsequently appealed the judgment and that appeal was heard in December 2025 at the Employment Appeal Tribunal. In January 2026, the Employment Appeal Tribunal dismissed MOD’s appeal and upheld the Employment Tribunal’s findings.

Following the judgement MOD submitted a request for leave to appeal directly to the Employment Appeal Tribunal. This was refused by the judge of the Employment Appeal Tribunal in February 2026.

An application for leave to appeal was subsequently submitted to the Inner House, Court of Session, which was heard at an oral hearing on 8 October 2026. MOD can confirm that it has received permission to appeal following the oral hearing.
