The Panel, Constantine Boulougouris, Bruce Cowley (sitting President) and Georgina Varley declined to conduct proceedings on an application by Jeremy Raper in relation to the affairs of GWR Group Limited. The application concerned allegations of association between, and non‑disclosure of, parties whose beneficial ownership of shares in GWR Group Limited were held in a nominee. The Panel considered, among other things, that there was insufficient material to demonstrate an association and that the circumstances did not relate to any current transaction. The Panel concluded there was no reasonable prospect that it would declare the circumstances unacceptable and referred issues to ASIC for further investigation.
